Introduction.
1.1 These Romance Experience Terms and Conditions govern your use of the websites, applications and other services offered by Romance Experience (the "Romance Experience Platform"). By using the Romance Experience Platform, you agree to be bound by these Terms.
1.2 In these Terms, when reference is made to "Romance Experience", "we", "us" or "our", it refers to the Romance Experience entity referred to in Schedule 1, with which you contract.
Romance Experience Platform Services.
2.1 The Romance Experience Platform is an online website that allows users ("Members") to post, offer, search and book services. Members who post and offer services are referred to as "Providers", while Members who search for, book or use services are referred to as "Customers".
2.2 Providers offer Experiences, as well as a variety of travel and related services (collectively, the "Provider Services"), and each offering of a Provider Service is considered an "Advertisement".
2.3 To access and use many features of the Romance Experience Platform, it is necessary to register an account and ensure the accuracy of the account information. Please note that Romance Experience acts solely as a provider of the Romance Experience Platform and does not own, control, offer or manage any Ads, Provider Services or tour services.
2.4 Experiencia Romance is not a party to contracts entered into directly between Suppliers and Customers, nor does it act as a travel agent or insurer. However, Romance Experience may act as agent for Members in connection with payment services, as specified in the Payment Terms of Service.
2.5 The web platform does not guarantee the availability of romance tourism activities in all destinations offered and reserves the right to modify or cancel any activity for any reason.
2.6 Payments shall be made through the web platform and shall be subject to the terms and conditions of use of the platform and the romance tour service provider. The web platform will not be responsible for refunds derived from a service, refunds will be made directly between the service provider and the client, being the platform only an intermediary between them.
2.7 To reserve an experience, payment must be made in a single payment within the romance experience page.
User Obligations and Responsibilities
3.1 If you are a Supplier, it is your responsibility to understand and comply with all laws, rules, regulations and contracts with third parties that are applicable to the Supplier's Services.
3.2 You agree to use the Romance Experience Platform in an ethical and lawful manner, and to comply with these Terms and any other policies or instructions provided by Romance Experience.
3.3 You warrant that the information provided during registration of your account and at any time thereafter is accurate, complete and up to date.
3.4 You are solely responsible for all activities conducted through your Romance Experience account, and you agree to keep your password and other access information secure and confidential.
Supplemental Terms and Policies
4.1 Along with these Terms, there are other terms and policies that supplement and govern your use of the Romance Experience Platform. These include, among others, the Privacy Policy, which describes the collection and use of personal data, and the Payment Terms, which govern the payment services provided by Romance Experience payment entities (collectively, "Romance Experience Payments").
4.2 We encourage you to read and understand these supplemental terms and policies, as they are an integral part of your relationship with Romance Experience.
Modifications to the Terms
5.1 Experience Romance reserves the right to modify these Terms at any time and at its sole discretion. Any modifications will be effective upon posting by Experience Romance on the Experience Romance Platform or otherwise notifying you.
5.2 It is your responsibility to periodically review the Terms to be aware of any updates. If you continue to use the Romance Experience Platform after modifications have been made, you will be deemed to have accepted the new terms.
Search for Provider Services
2.1.1 You have the option to use the search functionality of the Romance Experience Platform to search and find the Supplier's Services that match your preferences and needs.
2.1.2 You can apply various search criteria, such as type of Supplier Service, travel destination, dates and number of Clients, to obtain more accurate and relevant results.
2.1.3 In addition, the Romance Experience Platform offers you the ability to apply additional filters to refine the search results and further tailor them to your preferences, such as availability, other Member Reviews, customer service and cancellation history, popularity, previous trips and saved Ads, as well as specific requirements set by Suppliers.
2.1.4 Search results are generated taking into account the relevance of the Advertisements in relation to your search and other criteria mentioned above. These factors are considered to determine which Ads will be displayed in which order in the search results.
2.1.5 For more information on how search results work and how the different relevance criteria are applied, we recommend that you consult the Romance Experience support area, where you will find additional resources and answers to frequently asked questions related to this topic.
Showcase reservation
2.2 Ad Reservations
2.2.1 By making an Ad booking on the Romance Experience Platform, you accept and agree to pay all charges applicable to such booking. This includes the price of the Ad, as well as any applicable fees, such as the Romance Experience service fee, offline fees, taxes and other items identified during the checkout process. These combined charges are referred to as the "Total Price".
2.2.2 In addition, by booking an Advertisement, you authorize Romance Experience, through Romance Experience Payments, to make the corresponding charges to the Payment Method used to make the booking.
2.2.3 Upon receipt of the Booking Confirmation, a direct contract will be established between you and the Supplier for the provision of the Supplier's Services. This contract is known as a "Booking". In addition to these Terms, you will be subject to and responsible for complying with all terms and conditions set forth in the Reservation. This includes, but is not limited to, the cancellation policy and any other rules, standards, policies or requirements identified in the Advertisement or during the booking and payment process that are applicable to the Reservation.
2.2.4 It is your responsibility to carefully read and understand all of these rules, standards, policies and requirements before making an Ad booking. Please note that some Suppliers may work with a coProvider or be part of a team to provide the Supplier's Services.
Reservation Experience
2.3 Experience Reservations
2.3.1 By making an Experience Reservation through the Romance Experience Platform, you are granted a limited license to enter, occupy and use the Reserved Experience. This license is subject to the following conditions.
X The prices of the Romantic Experiences may vary and are subject to change without notice. The web platform will not be responsible for any pricing errors in the information provided. Prices within the platform include V.A.T., and are in Mexican pesos, the exchange rate will be taken based on the current exchange rate at the time of purchase of the service.
2.3.2 The Supplier reserves the right to re-enter the Experiences during your stay in the following circumstances: (i) where reasonably necessary, (ii) where permitted under the contract between you and the Supplier, and (iii) where consistent with applicable law.
2.3.3 In case you decide to stay longer than the agreed period and after the end of your Experience, the Supplier has the right to request your departure in accordance with applicable law.
2.3.4 It is important to note that you are not allowed to exceed the maximum number of Clients established for the booked Experience. You must respect and comply with this limitation to ensure compliance with the terms of your Reservation.
2.4 Reservations for Experiences and other Supplier Services
2.4.1 By making a Reservation for an Experience or other Provider Service through the Romance Experience Platform, you obtain the right to participate in, attend or use such Provider Service, as applicable.
2.4.2 It is your responsibility to ensure that you and any person you invite meet the minimum age, competency, fitness or other requirements specified by the Supplier. Before making a Reservation, we recommend that you carefully review the requirements and ensure that you comply with them.
2.4.3 You are also responsible for informing the Provider of any medical, physical condition or other circumstance that may affect your ability to participate in, attend or use the Provider's Service. This information is important to ensure your safety and well-being during the experience or service.
2.4.4 Unless express authorization is obtained, you are not permitted to allow any person to participate in a Provider Service unless that person is listed as an additional Customer during the booking process. It is essential to comply with this policy to ensure compliance with the terms and conditions set forth by the Supplier.
Cancellations, Setbacks and Refunds
3.1.1 In general, if you, as a Customer, decide to cancel a Reservation, the amount of the refund you will receive will be determined by the cancellation policy applicable to that Reservation. However, in certain situations, there are other policies that take precedence and establish the amount to be refunded.
3.1.2 If you are forced to cancel a Reservation due to circumstances beyond your control, you may be eligible for a full or partial refund under the Force Majeure Policy. This policy applies when unforeseen and unavoidable events, such as natural disasters or emergencies, prevent you from fulfilling your reservation.
Cancellations and refunds of the Tourist Experiences will be subject to the cancellation policy of the Tourist Service Provider. The web platform will not be responsible for cancellations and refunds, but will do its best to assist users in resolving any problems.
Free cancellation: If the reservation is cancelled within the first 72 hours after it has been made, no charge will be applied. What will be refunded is the service charge for the experience, but the fee for the use of the platform (commission) will not be refunded.
Standard cancellation policy: If the reservation is cancelled after the first 72 hours, a standard cancellation policy will apply, which may include a cancellation fee that increases as the start date of the Experience approaches, taking into account the cancellation date.
For example, if the reservation was made on January 1 to take place on May 1; and is cancelled on April 1 of the same year; the refund percentage is calculated as follows: 30 days elapsed from the date of cancellation / 120 days elapsed from the date of payment: 25% refund. In other words, there are 30 days left for the experience to take place, which corresponds to 25%.
In case a cancellation is made with less than 7 days notice, 100% of the total cost of the reservation may be charged. Reservations made with short notice (less than 72 hours) are non-refundable.
3.1.3 In the event that the Supplier cancels the Reservation or if you are faced with a
Travel Mishap (as defined in the Refund and Rebooking Assistance Policy), you may be eligible for a full or partial refund or assistance in making a new Reservation. The Reimbursement and Rebooking Assistance Policy applies in situations where
unexpected events or problems occur during your trip.
3.1.5 If you have any questions or need more information about cancellation policies, travel mishaps and refunds, we suggest that you contact the Romance Experience support team. They will be happy to help you and provide you with the necessary assistance.
4.1 Responsibilities
4.1.1 You are fully responsible for your actions and omissions, as well as the actions and omissions of anyone you invite to join or provide access to any Experiences, Experiences or other Provider Service. This includes the following:
(i) You are responsible for leaving the Experience (and any related personal property) in the same condition in which you found it upon arrival.
(ii) You are responsible for paying any reasonable claims for damages necessary to cover damage caused by you, your guests or your pets at the Experiences.
(iii) You must conduct yourself with integrity, treat others with respect and comply with all applicable laws at all times.
4.1.2 If you book for an additional Customer who is a minor or if you bring a minor to a Provider's Service, you must be legally authorized to act on behalf of the minor and shall be solely responsible for supervising the minor at all times.
4.2 Assumption of Risks
4.2.1 You acknowledge that many activities involve inherent risks and agree that, to the extent permitted by applicable law, you assume all risks arising from your access to and use of the Romance Experience Platform and any Content, including your stay in any Experience, your participation in any Experience, your use of any other Provider Services or any other interactions you have with other members, whether in person or online.
4.2.2 This means that you are responsible for evaluating whether a Provider Service is right for you and you voluntarily accept all associated risks. For example, Provider Services may involve risks of illness, bodily injury, disability or death, and you freely and voluntarily assume such risks by choosing to participate in such Provider Services.
General information
This Force Majeure Policy explains how we handle cancellations when unforeseen circumstances beyond your control arise after your reservation is made that prevent or prohibit you from completing your reservation. This policy applies to Experience reservations.
If cancellation is permitted under this policy, it will take precedence over the reservation cancellation policy. Users affected by any of the situations included in this policy may cancel their reservation and receive a refund. receive a refund or rescheduling of the reservation depending on the circumstances.
Suppliers who are affected by any of the situations covered by this policy may cancel, but the dates of the cancelled reservation may be marked as unavailable on their calendars depending on the circumstances.
Situations covered
This Policy uses the term "Situation" to refer to the following situations that occur after the reservation is made, which could not have been foreseen, and which prevent or legally prohibit the completion of the reservation.
Changes in government travel requirements. Unexpected changes in visa or passport application requirements imposed by a government authority that prevent travel to the destination. Loss or expiration of documents required for travel or other personal circumstances related to a traveler's authorization to travel are not covered.
Declared emergencies and epidemics. National or local emergencies, epidemics, pandemics and public health emergencies officially declared by the government. Diseases that are endemic or already associated with a particular area, such as dengue fever in Mexico, are not included.
Governmental travel restrictions. Travel restrictions imposed by a governmental authority that prevent or prohibit travel.
It does not include non-binding travel advisories and other similar advice that may be given by the government.
Military actions and other conflicts. Acts of war, conflicts, invasions, civil wars, terrorism, explosions, bombings, rebellions, riots, insurrection, public disorder and civil instability.
Natural disasters. Natural disasters, acts of God, large-scale interruptions of basic public services, volcanic eruptions, tsunamis and other extreme and abnormal meteorological phenomena. Weather or natural conditions that are usual and foreseeable in a given area are not included,
Situations not covered
All Other. This policy only allows reservations to be cancelled due to the situations described above. Everything else is excluded. Some examples of situations that this policy does not cover are: unexpected illness, disease or injury; governmental obligations such as jury duty, court appearances or military duty;
travel advisories or other government advice (that does not restrict or prohibit travel); cancellation or rescheduling of an event for which a reservation was made; and transportation disruptions that are not related to a covered situation, such as road closures and cancellations of flights, trains, buses and ferries. If you cancel a reservation in these cases, the amount refunded and/or rescheduling of experiences will be determined based on the applicable cancellation policy in each case.
Emergency cancellation: In some cases, travelers may be required to cancel their reservation due to an emergency, such as illness or death in the family. In such cases, the web platform may allow cancellation at no cost, but may require the presentation of documentation supporting the emergency.

If we notify you that this Policy applies to your reservation or post information confirming it, please follow the cancellation instructions we provide. When you receive notice or we post information about how this Policy applies, you will have the option to cancel under this Policy. If you believe that your case meets the conditions set forth in this Policy, but you have not received notice or we have not posted information, please contact us to cancel your reservation. In all cases, we will ask you to provide us with documentation showing how you have been affected by the situation or how it has affected your reservation.
